IRS Commercial Driver Suspension Appeals
Have you received an IRS Fail Sanction under SafeRoads Alberta? This is the most serious sanction (even more serious if you have previous convictions) and It’s important to know your rights and your options to appeal.
You have just 7 days from the date you received your IRS suspension to dispute it.
We offer a free, no-obligation consultation to help you understand your situation and make informed decisions. DO NOT pay the fine before speaking to us. Paying the fine is an automatic admission of guilt and it forfeits your right to appeal.
The IRS Fail Sanction is as follows:
An immediate 90-day suspension
30-day seizure of the vehicle you were driving (even if it isn’t yours)
Fines ranging from $1,000 to $2,000 plus a 20% victim fine surcharge
Participation in Alberta’s Ignition Interlock Program for 12 months to 36 months …or possibly for life
Participation in an education course
This can escalate to criminal charges with the IRS Fail sanction
This sanction is applied when you are suspected of operating a vehicle while impaired by alcohol (blood alcohol level 0.08 or higher) or drugs, if you fail an alcohol or drug test within two hours of operating the vehicle or refuse to submit to testing.
